On Friday, February 18th, just after 11:00 PM, a LaSalle Police officer responded to a report of a Ford sedan in the ditch at the intersection of Golfview Drive and Malden Road. When the officer arrived, the driver, an adult male from Windsor, was not injured and was still in the process of trying to free the vehicle from the ditch. After interacting with the driver, the officer could smell alcohol on his breath and made observations that lead the officer to reasonably believe that his ability to operate a motor vehicle was impaired. The driver was arrested for impaired operation of a motor vehicle and transported to the LaSalle Police Service where further tests were conducted, revealing that his blood alcohol concentration was more than three and a half times the legal limit. The driver is now charged with impaired operation of a motor vehicle and operating a motor vehicle with 80 milligrams or more of alcohol in his blood.
His drivers’ licence was immediately suspended for 90 days and his vehicle was towed and impounded for seven days. He will be responsible to pay all costs associated with reinstating his drivers’ licence, as well as the towing and impoundment.
If convicted he will have:
1) A criminal record,
2) For a first offence, a fine of not less than $1500.00. Depending on the circumstances a term of imprisonment may be imposed.
3) For a first offence, a prohibition from operating a motor vehicle for not less than one year and not more than three years.
